Provides that the court shall require a minor to participate in restorative justice programs, such as social service programs for high-risk youth, cognitive behavioral therapy, including family engagement and mentoring, and comply with referral recommendations if the minor: (1) has previously been placed on probation for an offense that involves the possession or discharge of a firearm not causing any injury; and (2) is convicted of a subsequent offense involving the possession or discharge of a firearm not causing any injury. |
| HB4285 | CRIM CD&CD CORR-FIREARM OFFENS (REP. KELLY CASSIDY) Amends the Criminal Code of 2012 and the Unified Code of Corrections. Provides that the 15-year penalty enhancement for committing various offenses with a firearm, applies only if the person committed the offense while personally armed with the firearm. |
| HB4422 | 2ND CHANCE PROBATION&WEAPONS (REP. KEVIN OLICKAL) Amends the Unified Code of Corrections. Provides that the conditions of Second Chance Probation that the defendant: (1) make full restitution to the victim or property owner; (2) obtain or attempt to obtain employment; (3) pay fines and costs; (4) attend educational courses designed to prepare the defendant for obtaining a high school diploma or to work toward passing high school equivalency testing or to work toward completing a vocational training program; and (5) perform community service are discretionary conditions of the probation (rather than mandatory conditions). Eliminates the provision that the defendant submit to periodic drug testing at a time and in a manner as ordered by the court, but no less than 3 times during the period of probation, with the cost of the testing to be paid by the defendant. Provides that the determination of the length of the First Time Weapon Offense Program, as determined by the court, shall be at the recommendation of the Program administrator and with the input from the State’s Attorney and defense counsel (rather than determined by the court at the recommendation of the Program administrator and State’s Attorney). Deletes provisions that the State’s Attorney must consent to the defendant’s sentencing to Second Chance Probation or to the First Time Weapon Offense Program. |
| HB5217 | FEDERAL BACKGROUND CHECKS (REP. KATIE STUART) Amends the Criminal Identification Act. Provides that information reported to the Illinois State Police under the Act is confidential and shall not be released unless expressly permitted by State or federal law. Provides that the Illinois State Police shall conduct a criminal history background check on an applicant if a qualified entity submits (1) a request to the Illinois State Police to perform a State and national background check on the applicant in a form and manner prescribed by the Illinois State Police that includes a statement containing the name, address, and date of birth appearing on a valid identification card or document issued by the State to the applicant; (2) a waiver on a form approved by the Illinois State Police that is signed by the applicant allowing the release of the State and national criminal history record information to the qualified entity; (3) the applicant’s fingerprints in an electronic format that complies with the form and manner for requesting and furnishing criminal history record information prescribed by the Illinois State Police; and (4) any fee prescribed by the Illinois State Police. Provides that, upon positive identification, the Illinois State Police shall provide the qualified entity with records of the applicant’s conviction of or entry of a plea of guilty or nolo contendere, finding of guilt, jury verdict, or entry of judgment or sentencing, including, but not limited to, convictions, preceding sentences of supervision, conditional discharge, or first offender probation, under the laws of any jurisdiction of the United States that is a felony or any crime directly related to providing care, treatment, education, training, instruction, supervision, or recreation to children, the elderly, or individuals with disabilities. Provides that any information received by a qualified entity under the provisions shall be used solely for internal purposes in determining the suitability of an applicant. Provides that a background check conducted under the provisions does not constitute compliance with any background check required by law. Provides that, if the Illinois State Police determines that the Illinois records provided to a qualified entity were inaccurate, then the Illinois State Police shall provide updated records to the qualified entity and the applicant. Defines terms. Makes other changes. |

Removes a prohibition from carrying a firearm into any real property under the control of the Cook County Forest Preserve District. Allows a forest preserve district to prohibit persons from carrying a firearm into any botanic garden, swimming pool, grounds of a swimming pool, athletic venue, picnic grove, nature center, grounds of a nature center, pavilion, grounds of a pavilion, golf course, driving range, adventure course, grounds of an adventure course, zipline building, grounds of a zipline, equestrian center, grounds of an equestrian center, exercise venue, grounds of an exercise venue, or any public or private gathering or special event conducted on property that requires the issuance of a permit. Adds an exception for persons carrying a firearm while traveling along a public right of way that touches or crosses forest preserve districts where firearms are prohibited. Adds an exception for forest preserve districts from provisions regarding required signage. |

Provides that a person commits the crime of violation of an order of protection under the Criminal Code of 1961 or the Criminal Code of 2012 if the person, in violation of an order to surrender the person’s firearms and firearm parts, knowingly transfers a firearm or firearm parts to the respondent or otherwise allows the respondent access to a firearm or firearm parts. Provides that, if the law enforcement agency seeks to correct or negate the warrant for the seizure of the respondent’s firearms and firearm parts, it shall take reasonable steps to notify the petitioner before appearing before the court. Makes technical changes. |
| HB4999 | MHDD CD-DISCLOSURE EXCEPTION (REP. BOB MORGAN) Amends the Mental Health and Developmental Disabilities Code. In provisions requiring specified medical and mental health professionals to notify the Department of Human Services whenever they determine a person who is under their professional care poses a clear and present danger to himself or herself, provides that the identity of the reporter shall not be disclosed to the subject of the report unless ordered by the Firearm Owner’s Identification Card Review Board or a court with appropriate jurisdiction in accordance with the Firearm Owners Identification Card Act. Provides that the Department of Human Services and its employees or agents shall not be held liable for damages in any civil action arising from the disclosure or non-disclosure of the information released in accordance with the Firearm Owners Identification Card Act. Adds similar provisions to the Mental Health and Developmental Disabilities Confidentiality Act. |
| HB5209 | FOID-MENTAL HEALTH (REP. MAURA HIRSCHAUER) Amends the Firearm Owners Identification Card Act. Provides that a person who has had the person’s Firearm Owner’s Identification Card revoked or denied under certain provisions because the person was a patient in a mental health facility shall not be permitted to obtain a Firearm Owner’s Identification Card, after the 5-year period has lapsed, unless the person has received a mental health evaluation by a licensed clinical mental health professional (rather than a physician, clinical psychologist, or qualified examiner as those terms are defined in the Mental Health and Developmental Disabilities Code). Provides that the person receiving a mental health evaluation shall share all collateral records with the licensed clinical mental health professional making the certification and shall attest that all collateral records have been provided before the evaluation. Provides that the licensed clinical mental health professional shall attest that the licensed clinical mental health professional has requested, received, reviewed, and considered all of the person’s collateral records in making the licensed clinical mental health professional’s determination that the person is not a clear and present danger to self or others. Provides that the licensed clinical mental health professional shall identify the types of collateral records received. Requires the licensed clinical mental health professional to make all reasonable attempts to obtain collateral records, and, if no collateral records are obtained, requires the licensed clinical mental health professional to document the efforts used to obtain such collateral records. Provides that the results of the mental health evaluations that are performed on or after the effective date of the amendatory Act shall be transmitted to the Illinois State Police. Defines terms. |
| HB5320 | EDUC/GUN OWNER-FIREARM SAFETY (REP. TRACY KATZ MUHL) Amends the Courses of Study Article of the School Code. Provides that instruction in safety education shall include the risks of firearm ownership and usage for students enrolled in grades 6 through 12. Sets forth what information this instruction must include, provides that the instruction may be taught by a licensed educator, school nurse, or school counselor, provides for student evaluation, and requires the State Board of Education to develop an age-appropriate, trauma-informed curriculum. Amends the School Safety Drill Act. Requires schools to provide, after a lockdown drill has been completed, a forum for trauma-informed discussion with students, parents, and staff regarding any mental health concerns that the impact of the lockdown drill has had on students. Amends the Firearm Dealer License Certification Act. Makes changes to require a certified firearm dealer to provide, at the time of application for a firearm purchase, specified information to increase awareness about the risks posed by firearms in the home and State laws regarding firearm ownership. |

LA SHAWN FORD) Urges the Illinois State Board of Education (ISBE) to identify and publish a list of evidence-based, decision-making, and impulse-control curricula that have been demonstrated to reduce violence involvement, make at least one free or low-cost curriculum available statewide for optional integration into existing Social and Emotional Learning (SEL) instruction, encourage districts to implement these programs using existing resources and staff development, and develop, pilot, and rigorously test new school-based decision-making and violence-prevention curricula that can be easily adopted by ISBE and schools statewide if proven effective in reducing violence. Urges the Administrative Office of the Illinois Courts (AOIC), the Department of Juvenile Justice (DJJ), and county probation and diversion programs to identify and approve evidence-based, decision-making curricula appropriate for minors under supervision, diversion, or detention, to encourage their integration as standard early interventions, and to implement these initiatives within existing budgets and structures. Urges the Illinois Department of Human Services (IDHS) and the Illinois Criminal Justice Information Authority (ICJIA) to coordinate with ISBE, AOIC, DJJ, and local partners to align violence-prevention curricula and community-based interventions across settings. Recognizes Professor Jens Ludwig for his groundbreaking research, leadership, and publication of Unforgiving Places. Acknowledges the contributions of other scholars and organizations advancing behavioral approaches to violence prevention. |
